Petitioner is apprehending his arrest in connection with Shakurabad P.S. Case No.132 of 2024, registered for the offence punishable u/s 147, 148, 149, 354, 302, 379, 120B of IPC. 3.

Allegedly, petitioner along with other co-accused persons armed with pistol and other weapons entered into the house of the informant and assaulted her to grab her share in ancestral property. They also assaulted the family members of the informant including her husband. Informant's husband died during the treatment.

It is submitted by learned senior counsel for the petitioner

Patna High Court CR. MISC. No.81046 of 2024(2) dt.10-12-2024 2/2 that petitioner is quite innocent and has not committed any offence. He has been falsely implicated in this case. There is admitted land dispute between the parties due to which petitioner has been made accused in the present case. There is no specific overt act attributed against the petitioner. It is further submitted that one of the co-accused, Shailesh Kumar has been granted anticipatory bail by this court vide order dated 13.11.2024 passed in Cr. Misc. No. 77089 of 2024. Petitioner has no criminal antecedent.

Learned APP for the State and learned counsel for the informant opposed the prayer for bail submitting that anticipatory bail of one co-accused person, namely, Upendra Kumar was dismissed by this court and the case of the petitioner also stands on the similar footing.

Considering the aforesaid facts and circumstances, I am not inclined to enlarge the petitioner on bail. The prayer for grant of anticipatory bail on his behalf is hereby rejected. 7.

This application is, accordingly, dismissed.
