JUSTICE ASHUTOSH KUMAR ORAL ORDER 26-04-2018 The petitioners seek bail in anticipation of their arrest in connection with Sanhaula P.S. Case No. 171 of 2017, dated 25.08.2017, instituted for the offences punishable under Sections 147, 149, 120B, 307, 323, 333, 337, 283, 353, 427, 504 and 323 of the Indian Penal Code. The petitioners and about fifty seven others are said to have instigated the villagers and blocked the road.
Patna High Court Cr.Misc. No.21439 of 2018 (2) dt.26-04-2018 2/2 They are also alleged to have exhorted the villagers in pelting stones causing injuries to the police party.
Learned counsel for the petitioner has submitted that one Sulekha Devi had tried to grab the temple land and a Title suit was filed by her for perfecting her claim over the said land. After the dismissal of the Title suit, the aforesaid Sulekha Devi, in collusion with the local police, got many cases lodged against the villagers, who are opposed to aforesaid Sulekha Devi appropriating the temple land. The three other cases which have been lodged against the petitioners are also at the instance of the local police in collusion with aforesaid Sulekha Devi.
Considering the aforesaid facts, the petitioners above named, in the event of their arrest or surrender before the learned Court below within a period of four weeks from today, be released on anticipatory bail on their furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-Vth, Bhagalpur in connection with Sanhaula P.S.
