2. Petitioners apprehend their arrest in a case registered for the offence punishable under sections 191 (2), 191(3), 190, 103(1) and 115(2) of the B.N.S., 2023 and Section 27 of the Arms Act.

3 . According to the FIR, informant namely, Uday Singh alleged that on 27.01.2025 at about 10:30 O' Clock ,

No.77751 of 2025(2) dt.17-11-2025 2/3 when informant was engaged in cleaning his residence , in the meanwhile , all the 23 named accused persons, including these petitioners armed with various weapons and ammunition came there and forcibly started to take possession of the informant's house , and upon protest, accused persons assaulted the family members of the informant. Thereafter, co-accused namely, Gautam Kumar and others fired upon son of informant Anmol Kumar, which hit on his back , as a result of which he died on way to the hospital.

4. Learned counsel for the petitioners submitted that petitioners are innocent and have falsely been implicated in this case . Petitioners are not the assailant and has played no role in the alleged occurrence . Specific accusation is against other coaccused persons who allegedly fired upon son of informant which hit at his back and while being taken to hospital he died . Allegation is general and omnibus against these petitioners. No specific overt act is alleged against them.

5 . Learned counsel for the State opposed the bail petition and submitted that there is specific allegation against petitioner No. 1 that he along with co-accused Gautam Kumar, Rakesh Kumar and Piyush Kumar fired which hit upon deceased as a result of which he died on way to the hospital.

6. Considering the seriousness and nature of accusation against petitioner No. 1 and gravit of offence , the prayer for pre - arrest bail of petitioner No. 1 is rejected.

7. Considering the general and omnibus allegation against petitioner Nos. 2, 3 , 4, 5 and 6 and other circumstances of the case , in the event of arrest or surrender within eight weeks from today, let the petitioner Nos. 2, 3 , 4, 5 and 6 as named above , be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate 1st Class, Patna City in connection with Khushrupur P.S. Case No. 43 of 2025 , subject to the conditions laid down under section 482 ( 2 ) of the Bharatiya Nagarik Suraksha Sanhita ( BNSS) , 2023 .
