JUSTICE ASHWANI KUMAR SINGH ORAL ORDER 26-04-2018 Heard learned counsel for the petitioners. No body appears on behalf of State.

The petitioners seek pre-arrest bail in connection with Raghunathpur P.S.Case No. 216 of 2017 registered under Sections 147,148,149,324,326,307 of the Indian Penal Code and Section 27 of the Arms Act.

It is submitted by the learned counsel for the petitioners that no specific avert act is attributed against them. It is further contended that the allegation of firing is confined against co-accused Ajay Gupta.

From perusal of the order impugned passed by the

Patna High Court Cr.Misc. No.22242 of 2018 (2) dt.26-04-2018 2/2 Additional District and sessions Judge-4, Siwan dated 9.03.2018, it would be appear that the only injury found on the person of the informant is attributed to the co-accused Ajay Gupta. Having regard to the submission made above, considering the facts and circumstances of the case, in the event of arrest or surrender before the court below within four weeks from today, the petitioners, who are said to be men of clean antecedent, are directed to be released on bail on furnishing bail bond of Rs.10,000/- (Rupees ten thousand) each with two sureties of the like amount each to the satisfaction of the learned A.C.J.M.- VIII, Siwan in connection with Raghnathpur P.S.Case No.216 of 2017, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
