The petitioner seeks regular bail in connection with Mohania P.S. Case No. 403 of 2019, registered for the offence punishable under Sections 30(a)/36 of the Bihar Prohibition and Excise (Amendment) Act, 2016. The allegation is regarding recovery of huge quantity of illicit liquor from a truck standing in the compound of a rice mill and the name of the petitioner is said to have been disclosed by the guard of the said rice mill, who was arrested from the spot.

The learned counsel for the petitioner submits that neither the rice mill belongs to the petitioner nor any recovery of illicit liquor has been made from the house of the

Patna High Court CR. MISC. No.75177 of 2019(3) dt.26-11-2019 2/2 petitioner nor the petitioner has got any connection with the truck in question. It is further submitted that the petitioner is having a clean antecedent and he is languishing in custody since 7.9.2019.

Having regard to the facts and circumstances of the case, I deem it fit and proper to enlarge the petitioner on regular bail.

Accordingly, the above named petitioner is directed to be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-3-cumSpecial Judge, Excise, Kaimur at Bhabua in connection with Mohania P.S. Case No. 403 of 2019.
