JUSTICE VINOD KUMAR SINHA ORAL ORDER 25-11-2019 This is an application for grant of anticipatory bail in connection with Babubarhi P. S. Case No. 133 of 2019, disclosing offences under Sections 341, 323, 324, 379, 354B, 504, 34 of IPC.

As per F.I.R. while the informant was filling the soil, the petitioners came variously armed and started abusing him and there is allegation against the petitioner no. 4 of assault by farsa and against petitioners no.2 and 4 tried to throttle his neck with Gamchha and started dragging. There are allegation against all the accused persons of assault to the informant and petitioner

Submission of the learned counsel for the petitioners is that there is case and counter case between the parties. The dispute is with respect to passage, in which, informant was trying to grab the same and there was a scuffle took place between the parties. The injuries are simple in nature, except one injury is on the neck due to pulling by Gamchha that does not inspire confidence.

Having heard both sides, considering the above submission, this application is allowed. Let the petitioners, above named, in the event of their arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) each with two sureties of the like amount to the satisfaction of learned A.C.J.M.-III, Madhubani, in connection with Babubarhi P. S. Case No. 133 of 2019, subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure. (Vinod Kumar Sinha, J) Sunil Shukla/- U T
