2. Petitioner apprehends arrest in a case registered for the offence punishable under sections 406, 420, 467, 468 , 471 and 120 B of the Indian Penal Code .

As per the prosecution case , an agreement was signed between the informant and co-accused Ram Kumar Singh and Babita Devi for purchase of residential plot for which co-accused Ram Kumar Singh received Rs. 10 lakh from the informant. It is further alleged that as per agreement informant had to purchase the land within 4 months but in the meantime co-accused Ram Kumar Singh and Babita Devi sold the land to other persons.

4. Learned counsel for the petitioner submits that petitioner has falsely been implicated in this case merely because he happens to be the son of co-accused Ram Kumar Singh and Babita Devi. Petitioner is only witness of the alleged sale deed. He is not beneficiary of the alleged transaction. He is neither vendor nor vendee . Moreover, the dispute involved in this case is purely civil in nature .

5. Learned counsel for the State and informant opposed the bail petition of the petitioner.

Considering the fact that dispute involved in this case is purely civil in nature and other circumstances of the case , in the event of arrest or surrender within eight weeks from today, let the petitioner, as named above, be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of the learned 4th ACJM Gaya in connection with Rampur P.S. case No. 349 of 2023 , subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure .
