JUSTICE DINESH KUMAR SINGH ORAL ORDER 30-04-2018 Heard learned counsel for the petitioners and learned Additional Public Prosecutor for the State. The petitioners are apprehending their arrest in connection with Bhagalpur GRPS Case No. 85 of 2017 for offences punishable under Sections 379 of the Indian Penal Code.

The prosecution case as per the written report of Rajiv Ranjan Jha, dated 10.05.2017, submitted to the Station House Officer, G.R.P., Bhagalpur, is to the effect that on 08.05.2017 at about 11.45 A.M. the informant was waiting at the Railway Station for Danapur Sahebganj Intercity. When he was boarding train the golden chain of the informant has been snatched from his wife's neck. The informant lodged the

Patna High Court Cr.Misc. No.23996 of 2018(2) dt.30-04-2018 2/3 fardbeyan and the case has been registered. The names of the petitioners sprang up on the confessional statement of Ajay Kumar Mandal.

It is submitted by the learned counsel for the petitioners that the names are not in the First Information Report. There is no recovery from the petitioners. Petitioner no. 1 has no criminal antecedent, but, petitioner no. 2 has one case to his credit on which he is on bail.

The learned Additional Public Prosecutor submits that the petitioners have been named in the confessional statement of the co-accused.

Considering the facts and circumstances of the case, the prayer of the petitioners for grant of anticipatory bail is allowed, in the event of surrender/arrest of the petitioners, named above, before the Court below, within four weeks from today in connection with Bhagalpur GRPS Case No. 85 of 2017 shall be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate, Railway, Bhagalpur, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
