The petitioner apprehends his arrest in connection with Gardanibagh P.S. Case No.296 of 2015, registered for the offence punishable under Section 384 of the Indian Penal Code. The petitioner is said to have demanded extortion money from his mobile phone.

Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in the present case. It is submitted that the petitioner has got no criminal antecedent as stated in paragraph-3 of the bail petition. It is further submitted that the mobile of the petitioner was lost while he was returning from Danapur market. It is submitted that the petitioner gave information to Danapur police station

Patna High Court CR. MISC. No.36 of 2023(3) dt.06-04-2023 2/2 and on several occasions demanded the information petition, but the same was not given by Danapur police station and the police did not register the case.

Learned APP for the State opposed the prayer for grant of anticipatory bail to the petitioner by submitting that the petitioner demanded extortion money from his personal mobile phone.

Taking into consideration the facts aforesaid, I am not inclined to enlarge the petitioner on anticipatory bail. Accordingly, the prayer for grant of anticipatory bail to the petitioner is hereby rejected.
