The petitioner is apprehending his arrest in connection with Bihta P.S.Case no.214 of 2018 registered for offences punishable under Sections 25(1-B)A, 26 of the Arms Act. Allegation against the petitioner as per FIR is that the police intercepted one person having pistol but seeing the police party he fled away throwing the pistol and later on the police came to know the name of the petitioner.

Submission of the learned counsel for the petitioner is that nothing has been recovered from his possession and he has no criminal antecedent.

Heard learned A.P.P. also.

Having heard both sides and in view of the facts and

Patna High Court Cr.Misc. No.27638 of 2018 (2) dt.11-05-2018 2/2 circumstances, as stated above, let the petitioner surrender before the learned court below within a period of four weeks from the date of receipt of the order and make prayer for regular bail, which will be considered by the learned court below on its own merit without being prejudiced by the order of this Court, if possible on the same day.
