09-05-2018 Heard Sri Ramesh Kumar Singh, learned counsel for petitioners and learned Addl. Public Prosecutor. Three petitioners, having clean antecedent, which fact has been stated in paragraph 3 of the petition apprehending their arrest in Jokihat P.S. Case No. 23 of 2018 registered for offence under Sections 379/34 of the Indian Penal Code, have prayed for grant of bail in the event of their arrest or surrender. Learned counsel for the petitioners has drawn my attention to F.I.R., particularly; page 14 to show that it is a peculiar case, in which, the informant had alleged that on 16-01-2018, theft was committed in respect of Honda pump-set machine, however; F.I.R. was lodged on 25-01-2018 with assertion that subsequently on inquiry, the informant got
Patna High Court Cr.Misc. No.27926 of 2018(2) dt.09-05-2018 2/2 information that petitioners were involved in the theft of Honda pump-set.
Considering the nature of accusation, clean antecedent as well as fact that F.I.R. was lodged much belatedly, let aforesaid three petitioners namely (1) Jafar, (2) Pappu @ Lalu and (3) Ehtesam, in the event of their arrest or surrender within a period of eight weeks from today, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Araria in connection with Jokihat P.S. Case No. 23 of 2018, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure, 1973.
