2. The petitioner seeks bail in a case registered for the offence punishable under Sections 126(2), 115(2), 109, 118(10, 303(2), 74, 352, 351(2) and 3(5) of the Bharatiya Nyaya Sanhita, 2023 later on Section 103 of the Bharatiya Nyaya Snahita, 2023 was added.

3. Informant, namely, Amresh Mal alleged that on 24.05.2025, at about 06:00 A.M., all the twelve accused persons including this petitioner came with weapons and started abusing him and damaging goods and when sister-in-law of the informant objected, co-accused Shashi Bhusan Mal tore her clothe and co-accused Ramakant Mal assaulted her by means of khanti. Petitioner is alleged to have assaulted the brother of the informant. Later on sister-in-law of the informant succumbed to

4. Learned counsel for the petitioner submits that the petitioner is not assailant of the deceased. He is alleged to have assaulted Kashi Mal (informant's brother), who sustained simple injury. Petitioner claims clean antecedent and is in custody since 25.08.2025. Charge-sheet has been submitted.

5. Learned A.P.P. for the State has vehemently opposed the prayer for grant of bail to the petitioner.

6. Considering the nature of accusation, period of custody and clean antecedents of the petitioner, the prayer for grant bail of to the petitioner is allowed.

7. Accordingly, let the above named petitioner be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-1st,, Bagaha, West Champaran in connection with Bagaha P.S. Case No. 139 of 2025.
