The petitioner apprehends his arrest in connection with Khagaria P.S. Case No.3 of 2018 registered under Sections 135 and 138 of the Electricity Act, pending in the court of the Chief Judicial Magistrate, Khagaria.

The accusation is of about non- making payment of electric bill of Rs.1,62,035/- and also committing theft of electricity, after disconnection, of causing loss of Rs.50698/-. The offence, as alleged in the F.I.R., is compoundable under Section 152 of the Electricity Act. As such, I am not inclined to grant privilege of pre-arrest bail to the petitioner.

Patna High Court Cr.Misc. No.29240 of 2018(2) dt.14-05-2018 2/2 Accordingly, the prayer of the petitioner for grant of privilege of pre-arrest bail stands dismissed with a liberty to the petitioner to approach the concerned authority for compounding the offence under Section 152 of the Electricity Act.
