The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 272/273 of the Indian Penal Code and Sections 47/53(B)(C) of the Bihar Excise Act, 2016.
Co-accused Sanjay Ram was apprehended by the police along with country-made liquor. Sanjay Ram disclosed that the said liquor was to be carried to the house of co-accused Abhimanyu Singh. He further disclosed that this petitioner and Abhimanyu Singh are the owner of the said liquor. Submission is that Abhimanyu Singh has already been allowed anticipatory bail by a coordinate Bench of this Court vide Annexure-4. Abhimanyu Singh. Abhimanyu
Patna High Court Cr.Misc. No.24012 of 2018 (3) dt.02-05-2018 2 / 2 Singh has also criminal antecedent vide para-65 of the case-diary and the petitioner has also disclosed his criminal cases under the Excise Act vide para-3 of the bail petition.
Considering the fact that allegation against the petitioner is similar to that of co-accused Abhimanyu Singh, let the petitioner, above named, in the event of his arrest or surrender before the Court below within a period of thirty days from the date of receipt of the order, be released on bail on furnishing bail bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of the Court-below where the case is pending in connection with Nautan Police Station Case No. 81 of 2016, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure as well as condition that the petitioner shall fully cooperate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
