JUSTICE VINOD KUMAR SINHA ORAL ORDER 19-11-2019 Petitioner seeks bail in anticipation of his arrest in connection with Bihta P.S. Case No. 579 of 2019 registered for the offences punishable under Sections 147, 148, 149, 341, 323, 325, 307, 379 of the Indian Penal Code and Section 27 of the Arms Act.

As per FIR petitioner along with other accused persons blocked the road by parking tractor and when the informant protested petitioner and two other accused persons damaged the vehicle and also assaulted brother of informant, causing injuries to him.

Submission of learned counsel for the petitioner is that there is general allegation against the petitioner and no specific allegation has been attributed against him and all the injuries are simple in nature except three injuries.

Patna High Court CR. MISC. No.73277 of 2019(2) dt.19-11-2019 2/2 Heard learned APP and learned counsel for the informant, who has opposed the prayer for anticipatory bail on the ground that brother of informant was brutally assaulted and three injuries over the body of injured are grievous in nature. In view of above facts and circumstances, I am not inclined to grant the privilege of anticipatory bail to the petitioner. He has to surrender and pray for regular bail. This application is, accordingly, dismissed.
