2. Petitioner apprehends his arrest in connection with Thakurganj P.S. Case No. 139 of 2023, registered for the offence punishable u/s 30(a)/37of Bihar Prohibition & Excise Act, 2016, pending in the court of learned ADJ-II-cum-Special Judge (Excise-I), Kishanganj.

3. After some arguments, learned counsel for the petitioner seeks permission to withdraw this application.

4. Permission is granted.

5. Accordingly, this application is dismissed as withdrawn.

6. However, if petitioner surrenders before the learned

No.79826 of 2023(2) dt.15-12-2023 2/2 Court below within six weeks from today and seeks regular bail, the learned Court below shall pass order on the same day in accordance with law without being prejudiced by this order considering the fact that petitioner is aged about 75 years and he has no criminal antecedent.
