The petitioners have prayed for regular bail in a case registered for the offence punishable under Section 392 of the Indian Penal Code.

The allegation against the petitioners along with others is of encircling the informant with weapons when he was returning to Begusarai on motorcycle and snatched the bag in

Patna High Court CR. MISC. No.3250 of 2023(2) dt.03-04-2023 2/3 which was kept Aadhar Card, Pan Card, R.C. book, Driving License, Rs. 7000/- cash and other materials with his motorcycle.

Learned counsel for the petitioners submits that the petitioners are innocent and have committed no offence. They have falsely been implicated in this case. He submitted that the petitioners are not named in the FIR. FIR has been lodged against three unknown miscreants. Nothing has been recovered from the conscious possession of the petitioners. He further submitted that on perusal of record, it appears that the name of these petitioners came into light on the basis of confessional statement of co-accused Rambir Kumar @ Ranjan Kumar. No T.I. Parade has been conducted by the prosecution. The petitioners are languishing in judicial custody since 20.10.2022. Learned APP appearing for the state has opposed the prayer of regular bail.

Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioners on bail. The above named petitioners are directed to be released on bail in connection with Nowkothi P.S. Case No. 99 of 2022 on furnishing bail bond of Rs.10,000/- (ten thousand) each with two sureties of the like
