JUSTICE SHIVAJI PANDEY ORAL ORDER 24-06-2020 Heard learned counsel for the petitioner and learned counsel for the State through virtual Court proceeding. In the present case, the petitioner is seeking bail in connection with Parsa P.S. Case No. 163 of 2018, registered for offence punishable under Sections 304 (B), 302, 201/34 of the Indian Penal Code.

The allegation against the co-accused including the petitioner is to have killed the sister of the informant due to nonfulfillment of demand of dowry, however, counsel for the petitioner submits that paragraph nos. 52, 53 & 54 of the case diary show that the petitioner was not present at the place of occurrence when the occurrence took place and the victim lady had committed suicide and the petitioner has falsely been implicated in the present case. Patna High Court CR. MISC. No.70357 of 2019(7) dt.24-06-2020 2/2 custody since 23.08.2018.

From perusal of different paragraphs of the case diary, it appears that independent witnesses have been examined and they have specifically stated that the victim had committed suicide of her own.

Considering the entire facts and circumstances of the case, the petitioner, above-named, is directed to be released on bail on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate-13, Saran at Chapra in connection with Parsa P.S.
