The petitioner apprehends his arrest in connection with Forbesganj Police Station Case No.861 of 2017/G.R. No.3609 of 2017 registered under Sections 414/34 of the Indian Penal Code. The accusation is that the informant being the Officer Incharge of Forbesganj Police Station proceeded for raid along with other police officials. In that course, one motorcycle, which was without registration number, was stopped and on search, 2 liters Indian Made Foreign Liquor was recovered from the motorcycle. The person, who was on the motorcycle, could not produce any paper regarding the motorcycle and disclosed that the motorcycle is a theft material. He also disclosed the name of 12 persons including the petitioner indulged in committing the theft of the motorcycle.

No.29262 of 2018(2) dt.14-05-2018 2/2 Learned counsel for the petitioner submits that, in fact, the petitioner is accused in six other cases, in which he is on bail, as detailed in paragraph-3 to this application, due to that reason, the petitioner has also been implicated in this case at the time of recording of the confessional statement of Sikandar Mandal, who was apprehended by the police with the motorcycle without registration number from which 2 liters Indian Made Foreign Liquor was recovered. Except that, there is nothing against the petitioner to show his involvement in the present case.
Having considered the facts and the circumstances of the case, let the petitioner, above named, in the event of his arrest or surrender by him within six weeks from today, be enlarged on bail on his furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of Sri S.K. Sharma, Judicial Magistrate, First Class, Araria, in connection with Forbesganj Police Station Case No.861 of 2017/G.R. No.3609 of 2017, subject to the conditions laid down under Section 438(2) Cr.P.C.
