ANJANA MISHRA ORAL ORDER 22-01-2020 Heard learned counsel for the petitioners and learned Additional Public Prosecutor for the State. The petitioners apprehend their arrest in connection with Nautan Police Station Case No. 62 of 2019 registered for the offence punishable under Sections 363/366(A)/34 of the Indian Penal Code.

Learned counsel for the petitioners submits that the petitioners are family members of the boy, namely, Mahesh Kumar with whom the victim girl has said that she has married. Learned counsel for the petitioners has drawn my attention to the

Patna High Court CR. MISC. No.71906 of 2019(2) dt.22-01-2020 2/2 statement made by the victim girl wherein she has categorically stated that she has gone with her own sweet-will. Learned counsel for the petitioner submits that she has also stated that she is willing to stay with her husband and that the medical report indicates that the victim girl is a major between 19-20 years.

Considering the aforementioned facts and circumstances and that the petitioners No. 1 to 7 have had no role in her kidnapping and it is, but a case of love marriage, let the petitioner above named be released on bail, in the event of his arrest or surrender before the court below within a period of four weeks from today, on furnishing bail bonds of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Bettiah, West Champaran, in connection with Nautan Police Station Case No. 62 of 2019, subject to the conditions as laid down under Section 438 (2) of the Cr.P.C.
