JUSTICE SATYAVRAT VERMA ORAL ORDER 04-03-2023 Heard learned counsel for the petitioner and learned APP for the State through video conferencing. The petitioner seeks bail in a case registered for the offences punishable under Sections 399, 402 of the Indian Penal Code and Sections 25(1-b)a, 26, 35 of the Arms Act. The learned counsel for the petitioner submits that the petitioner is in custody since 11.01.2022 and has antecedent of three cases and the informant alleges that a country-made pistol was recovered from the possession of the petitioner. The learned counsel for the petitioner submits that petitioner has been falsely implicated in the present case because of his antecedent and even presuming what has been alleged is true without admitting, then the petitioner has remained in custody for more than an year.
Patna High Court CR. MISC. No.996 of 2023(2) dt.04-03-2023 2/2 Learned A.P.P. opposes the bail application.
Considering the submission made by the learned counsel for the petitioner, the petitioner, above-named, is directed to be released on bail on his furnishing bail-bonds in the sum of Rs. 20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Hajipur Town P. S. Case No.29 of 2022, subject to condition that one of the bailors of the petitioner shall be his father namely, Kailash Rai.
The application stands allowed.
