The petitioners apprehend their arrest in connection with Nabinagar P.S. Case No. 97 of 2018, registered under Sections 379 and 411 of the Indian Penal Code. The accusation is of seizing four tractors attached with trailors respectively, belonging to the petitioners carrying the sand without valid chalan and also without covering the trailors.
Learned counsel for the petitioners submits that, in fact, all four petitioners are the owner of the four tractors, which were being driven by the drivers and the tractors were carrying
Patna High Court Cr.Misc. No.28970 of 2018(2) dt.14-05-2018 2/2 the soil mixed with sand for filling the village road, but the same were seized by the informant showing the loading of sand. Further submission is that petitioners have no criminal antecedent.
Having regard to the facts and circumstances of the case, let the above named petitioners be released on bail, in the event of their arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Aurangabad, in connection with Nabinagar P.S. Case No. 97 of 2018, subject to the condition as laid down under Section 438(2) of the Cr.P.C.
