04-07-2018 Heard Sri Prabhakar Singh, learned counsel for the petitioners and learned Addl. Public Prosecutor. Three petitioners, apprehending their arrest in Siwan Mufassil P.S. Case No. 466 of 2017 registered for offence under Sections 272, 273, 308, 420 of the Indian Penal Code and Section 41(1), 30(a)(b)(c), 35 of Bihar Prohibition and Excise Act, 2016 (for short "Excise Act"), have prayed for grant of anticipatory bail.

Learned counsel for petitioners tried to persuade the Court that petitioners have falsely been implicated, since in this case, recovery of liquor has been shown from a railway track. It has also been argued that petitioner no. 1 is handicap and as

Patna High Court Cr.Misc. No.31750 of 2018(4) dt.04-07-2018 2/2 such, at least he may be extended the privilege of anticipatory bail.

However, in view of statement made in paragraph - 3 of the petition, which indicates that petitioners are also accused in other cases relating to offence under the Excise Act, I do not find any ground to extend the privilege of anticipatory bail. The anticipatory bail petition in respect of three petitioners stands dismissed.
