KUMAR ORAL ORDER 21-05-2018 Heard learned counsel for the petitioner and the State. Petitioner seeks pre-arrest bail in Taraiyan P.S. Case No.44 of2018 instituted for the offences under Sections 341, 323, 307, 326(A), 337,504 and 506/34 of the I.P.C. Informant Vimal Kumar in his fardbeyan has alleged that on 15.02.2018 at 6.00 P.M. he had gone to collect milk from the accused Shyam Babu Rai but he was denied and upon which some altercation took place between the parties and thereafter accused Shyam Babu Rai threw acid upon the informant causing burn injuries in different parts of his body. Subsequently, three persons including the petitioner came at the place of occurrence and assaulted the informant and his family members by means of lathi danda and the allegation against the petitioner is of causing injury by brick upon Deepak Kumar and to this effect injury report

Patna High Court Cr.Misc. No.31074 of 2018 (2) dt.21-05-2018 2/2 has been annexed as Annexure-2 series which are simple in nature. The petitioner has no criminal antecedent and there is case and counter case with respect to same incident lodged by Shyam Babu Rai.

Considering the facts and circumstances of the case, let the petitioner, above named, in the event of his arrest or surrender before the court below within six weeks from today, be released on bail on furnishing bail bond of Rs.10,000/- with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate-IX, Chapra, Saran, in Tarainya P.S. Case No.44 of 2018 subject to the conditions as laid down under Section 438(2) of Cr.P.C.
