2. The petitioner seeks bail in connection with Giriak (Katrisarai) P.S. Case No. 255 of 2025 instituted for the offences under Sections 318(4), 319(2), 336(3), 61(2), 338, 340(2), 126(2), 115(2) & 132 of the Bharatiya Nyaya Sanhita, 2023 and Sections 66(c), 66(d) of the IT Act.

3. The prosecution case is that the petitioner along with others was found in a cowshed engaged in cyber cheating through mobile phones.

4. Learned counsel for the petitioner submitted that the petitioner has falsely been implicated in the present case. Except

Patna High Court CR. MISC. No.78871 of 2025(2) dt.14-11-2025 2/2 one mobile phone, no incriminating article has been recovered from the conscious possession of the petitioner. Learned counsel further submitted that petitioner has got no concern with the alleged offence. It has been submitted on behalf of the petitioner that the petitioner is in custody since 13.06.2025 and has no criminal antecedent. Other co-accused has been granted bail by this Court vide order dated 23-09-2025, passed in Cr. Misc. No. 69358 of 2025.

5. Learned A.P.P. for the State has vehemently opposed the prayer for grant of bail to the petitioner.

6. Considering the aforesaid facts and circumstances of the case as also the period of custody undergone by the petitioner and claim based on parity, this Court is inclined to grant bail to the petitioner.

7. Let the petitioner be released on bail on furnishing bail bonds of Rs. 15,000/- ( Rupees Fifteen Thousand) with two sureties of the like amount each to the satisfaction of Court below/concerned Court in connection with Giriak (Katrisarai) P.S. Case No. 255 of 2025.
