2. The petitioner apprehends his arrest in connection with Sirdala P.S. Case No. 463 of 2022 registered for the offence punishable under Section-414/34 of the Indian Penal Code.

3. Allegedly, on the secret information regarding theft of motorcycles, the informant reached at the place of occurrence and started checking the vehicle. In course of checking, two boys were found coming with motorcycle who seeing the police started fleeing away but out of them, one boy sitting on the motorcycle was apprehended whereas another boy succeeded in fleeing away. On query, the apprehended accused disclosed his name as Vikash Kumar whereas the another boy has been named as the petitioner.

4. It has been submitted on behalf of the petitioner

Patna High Court CR. MISC. No.84445 of 2023(3) dt.07-03-2024 2/2 that the petitioner is innocent and has falsely been implicated in the present case. The name of the petitioner has figured in confessional statement of co-accused. Nothing was recovered from his possession. He is a person of clean antecedent.

5. Learned APP appearing for the State opposed the prayer for grant of anticipatory bail.

Considering the above-mentioned facts and circumstances of the case, let the petitioner named above, in the event of his arrest or surrender within a period of four weeks be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-VI, Nawada in connection with Sirdala P.S. Case No. 463 of 2022 subject to the conditions as laid down under Section 438 of the Cr.P.C.

7. After accepting bail bond of the petitioner, the learned court below shall verify his criminal antecedent and if, he is found involved in any other case, his bail bond shall liable to be cancelled.
