JUSTICE VINOD KUMAR SINHA ORAL ORDER 09-05-2018 The petitioner is apprehending his arrest in connection with Sadar (Mu) P.S. Case No. 605 of 2015, registered for offences punishable under Sections 376 and 120B of the Indian Penal Code.

Initially a complaint case was lodged by the informant, which was referred under Section 156(3) for registration of F.I.R and the allegation against the petitioner that he committed rape on the minor daughter of the informant.

It has been submitted on behalf of the petitioner that there is delay in filing the complaint case and the doctor on examination of the victim girl as not found any sign of rape or any injury and the fact is that the informant wanted to marry his daughter with the petitioner and when the family of petitioner refused, informant

Patna High Court Cr.Misc. No.27419 of 2018 (2) dt.09-05-2018 2/2 came out with such an allegation and no such occurrence has ever taken place.

Learned counsel for the State opposed the prayer for bail. Having heard both sides, considering the facts and circumstances of the case, nature of offence I am not inclined to grant the privilege of anticipatory bail to the petitioner. This application is accordingly dismissed.
