KUMAR ORAL ORDER 23-05-2018 Heard learned counsel for the petitioner and the State. Petitioner seeks pre-arrest bail in Govindganj P.S. Case No.148 of 2017 instituted for the offences under Sections 341, 323, 307, 414, 504, 506/34 of the I.P.C. and Sections 25(1-b) a, 26, 35 of the Arms Act.

The informant has alleged that on 15.6.2017 while he was returning to his house accused Vivek Pandey and Sandeep Sah tried to strangulate him thereafter, on hearing alarm raised by him people of vicinity assembled there and they apprehended two persons who disclosed their names as Vivek Pandey and Sandeep Sah.

Learned counsel for the petitioner submits that allegation against the petitioner is that co-accused, Vivek Pandey confessed

However, it is being denied on behalf of the petitioner that he is owner of the motor cycle. It has been further submitted that he is innocent and he has been falsely implicated in this case. He does not have any criminal antecedent.

Considering the facts and circumstances of the case, le the petitioner, above named, in the event of his arrest or surrender before the court below within six weeks from today, be released on bail on furnishing bail bond of Rs.10,000/- with two sureties of the like amount each to the satisfaction of 1st Addl.C.J.M.- Motihari, East Champaran, in Govindganj P.S. Case No.148 of 2017 subject to the conditions as laid down under Section 438(2) of Cr.P.C.
