The petitioner apprehends his arrest in connection with Dinara P.S. Case no. 113 of 2017, registered under Sections 366(A)/34 of the Indian Penal Code and Section 8 of POCSO Act.
The accusation is of kidnapping of the daughter of the informant by the petitioner with the help of one Chandan for the purpose of marriage.
Learned counsel for the petitioner submits that, in fact, the petitioner and daughter of the informant were studying in same school and daughter of informant fall in love with this petitioner and she left her parental house according to her sweet will and performed marriage with this petitioner. The
Patna High Court Cr.Misc. No.31287 of 2018(2) dt.12-06-2018 2/2 daughter of informant has given the statement under Section 164 of Cr.P.C. on 03.07.2017 to the said effect, which would appear from Annexure-2.
Having regard to the facts and circumstances of the case, let the above named petitioner, be released on bail, in the event of his arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the Addl. Sessions Judge-I, Rohtas at Sasaram in connection with Dinara P.S. Case No. 113 of 2017, subject to the condition as laid down under Section 438
(2) of the Cr.P.C.
