JUSTICE VINOD KUMAR SINHA ORAL ORDER 28-06-2018 Petitioner apprehends his arrest in connection with Mehsi P.S.Case No. 306 of 2017 registered for the offences punishable under Sections 323, 342, 307, 379, 448, 325, 447 and 504/34 of the Indian Penal Code.

Allegation against the petitioner is of assault by rod to the informant, causing injury on the hand.

Submission of learned counsel for the petitioner is that there is case and counter case between the parties and both sides have received injuries and though the injury on the person of informant is grievous but not on the vital part and petitioner is suffering from brain hemorrhage.

Having heard both sides and in the facts and

No.32423 of 2018 (2) dt.28-06-2018 2/2 circumstances, let the petitioner, named above, in the event of his arrest or surrender be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate-VI, East Champaran at Motihari, in connection with Mehsi P.S.Case No. 306 of 2017, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure and further conditions are that one of the bailors shall be a local person having sufficient immoveable properties within the jurisdiction of court concerned.
