The petitioner seeks regular bail in connection with Chhatapur P.S.Case No.227 of 2017/G.R. No.1423 of 2017 registered for offences punishable under Sections 457 and 380 of the Indian Penal Code.

As per FIR, there is allegation of commission of the theft in the house of the informant. FIR is against the unknown and later on it appears that name of the petitioner transpired during the course of investigation and stolen mobile was recovered in which SIM of the petitioner was found. It further appears that he is accused in three more cases.

Submission of the learned counsel for the petitioner is that except the above there is nothing against the petitioner and

Patna High Court CR. MISC. No.76019 of 2019(3) dt.10-12-2019 2/2 there is no other recovery. He is in custody for five months and not being produced for TIP.

Having heard both sides and in view of the facts and circumstances, as stated above, let the petitioner, above named, be enlarged on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned ACJM VIth, Supaul/Incharge Successor Court in Chhatapur P.S. Case No.227 of 2017/G.R.No.1423 of 2017 with condition to appear before the local Police Station for a period of six months in the first week of each month so that the Police may watch conduct of the petitioner.

With the above direction, this application is allowed.
