In this case, the petitioners are apprehending their arrest in connection with Thakurganj P.S. Case No. 35 of 2018 registered for offences under sections 447, 366, 511, 506, 120B/34 of the Indian Penal Code.
An allegation has been made in the First Information Report that all the named accused persons came to the house of the Informant and they tried to kidnap the daughter of the Informant but, due to intervention of the people of the locality, they failed to kidnap her.
In the written statement, the Informant has stated that all the accused persons came covering their face but, he has given the name of all the accused persons. At the same time,
Patna High Court Cr.Misc. No.30541 of 2018(2) dt.18-05-2018 2/2 Nikahnama has been annexed as Annexure-2 which reflects that Iqbal Ahmad Shaikh, who is brother of the petitioner nos. 1 & 2, has entered into marriage with the girl. As per statement made by the petitioners, actually they have gone there for Vidai, instead of allowing the girl with them, they have lodged the present criminal case against them.
Looking to the entire facts and circumstances of the case, let the petitioners, above named, in the event of their arrest or surrender before the court below within a period of four weeks from today, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Kishanganj in connection with Thakurganj P.S. Case No. 35 of 2018, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. as also subject to condition that whenever the police will call the petitioners for investigation/interrogation, they will remain present and if they would not present themselves, the privilege of grant of anticipatory bail shall be deemed to have been canceled.
