JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 16-11-2019 Heard learned counsel for the petitioners and learned Additional Public Prosecutor for the State The petitioners are apprehending their arrest in a case registered for the offences punishable under Section 302/34 of the Indian Penal Code.

As per prosecution case, the informant's son was married with Anjali Kumari and after one month of their marriage, all the accused persons including the petitioners assaulted the informant's son and during course of treatment, he died in the hospital.

It is submitted on behalf of the petitioners that the petitioners have falsely been implicated in this case only due to

It is also submitted that petitioner no.1 is grand-mother-in-law and petitioner no.2 is grand-fatherin-law of the deceased who are aged about 60 and 62 years respectively. It is also submitted that the petitioners have no concern with the alleged occurrence. They are living separate in mess and business. There is no eye witness to the alleged occurrence. Petitioners have got clean antecedent. In the aforesaid facts and circumstances, let the above named petitioners be released on bail in the event of their arrest or surrender before the Court below within a period of six weeks from the date of receipt of the order, be released on bail on furnishing bail bonds of Rs.

10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned ACJM, Hilsa under Nalanda Judgeship at Biharsharif/successor Court in connection with Hilsa P.S.Case No.405 of 2019, with following conditions:- (i) Petitioners shall cooperate in the trial and shall be properly represented on each and every date fixed by the court and shall remain physically present as directed by the Court and their absence on two consecutive dates without sufficient reason, their bail bond shall be cancelled by the court below.
