JUSTICE VINOD KUMAR SINHA ORAL ORDER 11-12-2019 Petitioner seeks regular bail in connection with Kotwali (Jogsar) P. S. Case No. 305 of 2019 registered for the offences punishable under Sections 406, 420, 467, 468, 120B and 471 of IPC.

As per F.I.R. petitioner and other accused persons in conspiracy got a sale deed executed from the brother of the informant, who is instant and not married.

Submission of the learned counsel for the petitioner is that even from the materials, which will be appeared that sale deed was executed in favour of co-accused Anmol Kumar and he is only identifier of the sale deed. He is not the beneficiary and he is in custody for 04 months. Charge sheet has already been submitted. He is ready to abide by any condition imposed

Heard learned A.P.P. as well as learned counsel for the informant, who has opposed the prayer for bail. Having heard both sides, in view of the facts and circumstances, as stated above, let the petitioner above named, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount to the satisfaction of learned C.J.M. Bhagalpur, in connection with Kotwali (Jogsar) P. S. Case No. 305 of 2019, subject to the condition that one of the bailors of the petitioner shall be a local person having sufficient immovable property within the jurisdiction of the court concerned.
