2. The present petition has been preferred for the grant of following relief(s):

"(i) to issue an appropriate order/s, direction/s including a writ preferably in the nature of Mandamus for commanding and directing upon the District Land Acquisition Officer, Saran (herein after) refer to as Respondent No. 5 to make the payment of

Patna High Court CWJC No.17805 of 2025(2) dt.18-11-2025 2/3 compensation to the petitioner for Acquisition his land appertaining to Khata No. 77, Survey Plot No. 151 measuring an area of 0.1925 Acre treating his land into a category of Developing land as a commercial situated in Mauja-Saguni P.S. Parsa, District- Saran.

(ii) to direct the Respondent No. 05 to make the payment of Compensation to the petitioner amounting to Rs.22,34, 925/-for the acquire land equivalent to the market rate as per section 26(a) of the Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2023.

(iii) to direct the Respondent No. 5 treated the land in question for payment of compensation with respect to the land of petitioner situated in Mauza Saguni, P.S.-Parsa, District- Saran acquired for the construction of Parsa bypass Road and thereby rejected the claim of the petitioner treating his land in the category of developing land that is commercial. (iv) to any other relief/s to which the

3. Learned State counsel submits that the award has been prepared but the petitioner has chosen not to receive it as he wants fresh categorization of the land.

4. In the opinion of the Court, the petitioner ought to have received the amount and if still has grievance, always has the option to agitate the same before appropriate authority/court.

5. In that background, the writ petition is disposed of allowing the petitioner to either receive the award and pursue the matter and/or to approach appropriate authority/court for the redressal of the grievance.
