The petitioner seeks bail in connection with NTPC P. S. Case No. 47 of 2019 registered under Sections 419, 420, 467 and 468 read with Section 34 of the Indian Penal Code. Learned counsel for the petitioner submitted that the informant of the case could not verify the papers of the petitioner correctly and under some confusion, the instant case has been lodged. His candidature may by verified by online application form submitted by him for the post of constable. His Finger prints may also be verified from his Adhar Card. Allegation of impersonation made against him is entirely wrong. He has further contended that co-accused Phantush Kumar

Patna High Court CR. MISC. No.71038 of 2019(2) dt.04-12-2019 2/2 having identical allegation to that of the petitioner has already been granted bail by a co-ordinate Bench of this Court vide order dated 18.11.2019 passed in Cr. Misc. No. 70083 of 2019. Learned counsel for the State has opposed the prayer for grant of bail to the petitioner.

Considering the allegation made in the FIR, submissions made above and the fact that the petitioner is in custody as an under-trial prisoner since 04.09.2019, the prayer is allowed. The petitioner is directed to be released on bail on furnishing bail bond of Rs.10,000/- (rupees ten thousand only) with two sureties of the like amount each to the satisfaction of learned CJM, Bhagalpur in connection with NTPC P. S. Case No. 47 of 2019.
