JUSTICE JITENDRA MOHAN SHARMA ORAL ORDER 20-06-2018 Heard the learned counsel for the petitioner, the learned A.P.P. for the State as also the learned counsel for the informant.

The petitioner wants to renew his prayer for bail which was earlier rejected by order dated 08.01.2015 passed in Cr Misc. No. 29076 of 2014, on the ground that the petitioner has not been charge sheeted in this case but cognizance was taken against him. However, in Cr. Revision No. 61 of 2015 the learned Sessions Judge, Hajipur has been pleased to set aside the order taking cognizance and the Criminal Revision was allowed but in Cr. Misc. No. 4018 of 2016 the order passed by the learned Sessions Judge has been stayed resulting the order passed by the learned Chief Judicial Magistrate has become operative.

No.32023 of 2018 (2) dt.20-06-2018 2/2 Allegation against the petitioner is that he caught hand of the informant and with the help of other co-accused took away her in the wheat field of Chandrashekhar Singh where the petitioner pressed mouth and other co-accused committed rape with her.

The learned A.P.P. duly assisted by the learned counsel for the informant opposes prayer for bail of the petitioner. In the facts and circumstances stated above, finding no good ground for reconsideration of prayer for bail, again prayer for bail of the petitioner stands rejected in connection with Desari P.S. Case No. 47 of 2013 pending in the court of A.C.J.M-II, Hajipur at Vaishali.
