2. Petitioners apprehend their arrest in a case registered for the offence punishable under sections 147, 149, 341 , 323 , 448 , 307, 354, 427, 379 and 504 of the Indian Penal Code and 27 of Arms Act.
3 . As per the prosecution case , on the alleged date and time of occurrence , these petitioners assaulted the informant with fists and slap and ssnatched Rs. 5,000/- cash from him.
4. It is submitted on behalf of the petitioners that both the parties are co-villagers and due to petty dispute , this false
Patna High Court CR. MISC. No.81477 of 2024(3) dt.23-01-2025 2/2 and concocted case has been lodged against these petitioners. Allegation is general and omnibus. There is no injury report on record to substantiate the allegation . Rest of the allegation is super-addition to make the case grave in nature against these petitioners.
5 . Learned counsel for the State oppose the bail petition .
6 Considering the fact that allegation is general and omnibus against these petitioners and other circumstances of the case , in the event of arrest or surrender within eight weeks from today, let the petitioners, as named above, be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) each with two sureties of the like amount each to the satisfaction of the learned ACJM Patna City in connection with Fatuha P.S. Case No. 598 of 2024 , subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure . (Prabhat Kumar Singh, J) Koushik/- U T
