JUSTICE VINOD KUMAR SINHA ORAL ORDER 13-01-2020 Petitioners seek regular bail in connection with Ladaniya P. S. Case No. 170 of 2019 registered for the offences punishable under Sections 272 & 273 and Section 30(a) of the Bihar Prohibition & Excise Act, 2016.

Recovery of 60 liters of liquor from the motorcycle and petitioners were arrested while fleeing away from the place of occurrence.

Submission of the learned counsel for the petitioner is that except confessional statement of the co-accused, there is nothing against them. The motorcycle does not belong to the petitioners. They are in custody for three and half months. Charge sheet has already been submitted and as such, there is no

Having heard both sides, in view of the facts and circumstances, as stated above, let the petitioners, above named, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount to the satisfaction of learned 2nd Additional Sessions Judge-cum-Special Judge, Excise Act, Madhubani, in connection with Ladaniya P. S. Case No. 170 of 2019, subject to the condition that one of the bailors of the petitioners shall be a local person having sufficient immovable property within the jurisdiction of the court concerned.
