The petitioner apprehends his arrest in connection with Uchkagaon P.S. Case No.266 of 2022 registered under Section 414 of the Indian Penal Code and Sections 11(a)(b)(d) (e)(f) of the Prevention of Cruelty to Animal Act. Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. It is submitted that at the time of checking, all the cattle and calves were alive but the police did not care them due to which one of the calves died in the custody of police. The F.I.R. itself shows that it was registered on 07.08.2022 but the same was sent to the learned court after three days of lodging F.I.R. It is further submitted that the vehicle and cattle were not stolen properties

Patna High Court CR. MISC. No.1287 of 2023(2) dt.08-05-2023 2/2 rather they belong to the petitioner as is evident from Annexure 2 to this petition. The petitioner has got no criminal antecedent. Having considered the above facts and circumstances of the case and the submissions advanced on behalf of the parties, let the above named petitioner be released on bail, in the event of arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing personal bond to the satisfaction of A.C.J.M., Gopalganj in connection with Uchkagaon P.S. Case No.266 of 2022, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. (Arvind Srivastava, J) Harish/- U T
