Petitioner apprehends arrest in connection with Sakra P.S. Cae No. 27 of 2017 registered for the offence punishable under sections 272 and 273 of the Indian Penal Code and 35(C) of the Bihar Prohibition and Excise Act, 2016. Learned counsel appearing for the petitioner submits that petitioner has been falsely implicated in the present case merely on basis of suspicion, as a matter of fact nothing has been recovered from the conscious possession of this petitioner. He has no connection with Smart India Marketing Company. Petitioner is a man of clean antecedent.

Considering the facts and circumstances of the case and the submissions advanced on behalf of the parties, let the

Case No. 27 of 2017 subject to the conditions laid down under section 438(2) Cr.P.C.
