JUSTICE ASHUTOSH KUMAR ORAL ORDER 05-03-2020 The petitioner seeks bail in connection with POCSO Case No. 47 of 2019, arising out of Ara Nagar P.S. Case No. 340 of 2019 dated 19.07.2019 instituted for the offences under Sections 376/376(F), 370/370(A), 376(AB), 376(DB) of the Indian Penal Code, Sections 4, 6 and 8 of the POCSO Act, Section 75 of the J.J. Act, Section 5(CC) of the Immoral Trafficking Prevention Act, 1956 and Sections 4/8 of the POCSO Act.

Mr. Vikram Deo Singh, learned advocate for the petitioner has submitted that the petitioner is not named in the FIR nor the victim girl has named him in her 164 statement. The only material against the petitioner is the confession of another accused viz. Anita who is alleged to have made the victim work as a prostitute.

No.72165 of 2019(4) dt.05-03-2020 2/2 However, considering the entire set of facts collected during the course of investigation, I am not inclined to grant bail to the petitioner notwithstanding the fact that he is in custody since 01.08.2019. Accordingly, prayer for bail is rejected.

That chargesheet in this case having been submitted long time back, this Court directs that the trial of the accused persons should commence without any delay and be concluded also expeditiously.
