This application is for grant of regular bail in connection with Benipatti P.S.Case No.133 of 2016 (G.R. No.652 of 2016) for the offences under Sections 364, 379/34 of the Indian Penal Code.

Earlier the prayer for bail of the petitioner was rejected twice vide order dated 9.3.2017 passed in Cr. Misc. No.3752 of 2017 and again vide order dated 1.1.2018 passed in Cr. Misc. No.60187 of 2017 and thereafter the present petitioner has come before this Court and then a Co-ordinate Bench of this Court has again disposed of this application vide order dated 28.8.2019 passed in Cr. Misc. No.34141 of 2019. Submission of the learned counsel for the petitioner is that he is in custody for about 3 1⁄2 years but the

Patna High Court CR. MISC. No.71291 of 2019(3) dt.25-02-2020 2/2 trial has not been concluded up till now.

Heard learned A.P.P. and perused the report from which it appears that out of 12 charge sheeted witnesses six witnesses have already been examined and seventh witness has partly been examined and he assured that he will expedite the trial and conclude the same preferably within a period of three months..

Accordingly, this application is dismissed.
