The petitioner is languishing in custody in connection with Cheria Bariyarpur P.S. Case No. 86 of 2019, for the offence punishable under Sections 341, 342, 307, 386, 387 and 34 of the Indian Penal Code and Section 27 of the Arms Act. It appears that similarly situated co-accused Pankaj Sahni has already been allowed bail by a coordinate Bench of this Court in Criminal Misc. No. 63313 of 2019 on 25.10.2019. Petitioner has on oath that he has got no criminal antecedent. It is further submitted that the petitioner is in custody since 15.07.2019.
Considering the facts aforesaid, let the petitioner,
Patna High Court CR. MISC. No.76347 of 2019(2) dt.29-11-2019 2/2 above named, be released on bail on furnishing bail bond of Rs. 20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of the learned court below where the case is pending in connection with Cheria Bariyarpur P.S. Case No. 86 of 2019, with following conditions: (a) Both the bailors shall be the resident of territorial jurisdiction of the learned court below; and (b) The petitioner shall fully cooperate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
