Learned counsel for the petitioner has submitted that as per Circular of the Department of Environment, Forest and Climate Change issued through memo no. 1258 dated 23.06.2020 (Annexure-P/7) paragraph-2 of the circular, on the death of licensee, the license shall be renewed in favour of heir of the licensee. The petitioner is wife of the original licensee, who died on 25.04.2015. Prior to the death of the licensee, on the ground of his ailment, an application for renewal of licence and transfer of saw mill was made by the petitioner, the widow of the licensee. During pendency of that application, the original licensee died. He has further submitted that the application for

Patna High Court CWJC No.17405 of 2024(2) dt.21-11-2024 2/2 renewal of license and transfer of saw mill is pending before the Divisional Forest Officer, Motihari.

3. The Divisional Forest Officer, Motihari is directed to dispose of the application in accordance with law within a period of one month. The Divisional Forest Officer, Motihari shall adhere with the circular dated 23.06.2020, if there is no cogent reason for deviation.

4. With the aforesaid directions/observations, this writ petition stands disposed of.
