====================================================== CORAM: HONOURABLE MR. JUSTICE ANJANI KUMAR SHARAN ORAL ORDER 05-03-2025 Heard learned counsel for the petitioner, learned APP for the State and learned counsel for the informant.

2. The petitioner seeks bail in a case registered for the offences punishable u/s 126(2), 115(2), 118(2), 109(1), 329(3), 329(4), 303(2), 351(3), 352, 3(5) of the B.N.S., 2023.

3. Allegation against the petitioner is that he along with one Jay Prakash Singh assaulted the informant's son with knifes due to which he sustained injury.

4. It is submitted by learned counsel for the petitioner that petitioner is quite innocent and has committed no offence. No such occurrence as alleged has ever taken place. He has falsely been implicated in this case due to ulterior motive. The allegation levelled against the petitioner is totally false and based on

Patna High Court CR. MISC. No.81384 of 2024(4) dt.05-03-2025 2/2 concocted facts. Nothing specific has been attributed against the petitioner. Both petitioner and informant are next door neighbours and there is previous enmity between them as the daughter of the informant solemnized marriage with the petitioner's son without consent of her parents. Learned counsel further submits that there is case and counter case between the parties. He further submits that petitioner has no criminal antecedent and he has been languishing in custody since 08.08.2024.

5. Learned APP for the State as well as learned counsel for the informant opposes the prayer for bail.

Considering the arguments of the parties, the period of custody and the fact that there is case and counter case between the parties, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned court below where the case is pending/the Successor Court, in connection with Daraunda P.S. Case No.346 of 2024.
