====================================================== CORAM: HONOURABLE MR. JUSTICE SATYAVRAT VERMA ORAL ORDER 29-04-2023 Heard learned counsel for the petitioner and learned A.P.P. for the State.
The petitioner seeks bail in a case registered for the offences punishable under Sections 147, 149, 323, 307, 354, 448 and 427 of the Indian Penal Code.
Learned counsel for the petitioner submits that the petitioner has antecedent of two cases and is in custody since 12.09.2022.
It is submitted that allegation against the petitioner is of assaulting the wife and son of the informant. It is further submitted that petitioner is alleged to have assaulted the son of the informant on his head by iron rod.
Learned counsel for the petitioner submits that petitioner has been falsely implicated in the present case. It is further submitted that the petitioner and the informant are

No.3348 of 2023(2) dt.29-04-2023 2/2 relatives and on account of dispute relating to construction with the brother of the informant, namely, Rajesh Paswan, the present false case has been instituted. It is next submitted that though allegation is of assault on the head by the petitioner on the son of the informant but then the order impugned does not record any injury. It is also submitted that since no injury was caused, as such, no injury report is there in the case diary. Learned A.P.P. for the State vehemently opposes the prayer for regular bail of the petitioner.
Considering the submission made by the learned counsel for the petitioner, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Marachi P.S. Case No. 142 of 2022.
