JUSTICE VINOD KUMAR SINHA ORAL ORDER 18-07-2018 The petitioner is apprehending his arrest in connection with Narpatganj (Ghurna) P.S. Case No. 250/18, registered for offences punishable under Sections 386 of the Indian Penal Code. Allegation against the petitioner that he threatened the informant on phone to kill him.
It has been submitted on behalf of the petitioner that out and out false and fabricated allegation has been levelled against the petitioner and falsity of the case will appear from the fact that no motive behind the said threatening has been assigned by the informant and further no rangdari has been demanded. It has also been submitted that the petitioner is a teacher and has no criminal antecedent.
Learned counsel for the State opposed the prayer for bail and submitted that call detail records suggest that the petitioner has called the informant.

No.36429 of 2018 (3) dt.18-07-2018 2/2 Having heard both sides, in view of the above facts, let the petitioner above named, in the event of his arrest or surrender before the court below within a period of six weeks from the date of receipt/production of a copy of this order, be enlarged on bail on furnishing bond of Rs. 25,000 (Rs. Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned CJM, Araria in connection with Narpatganj (Ghurna) P.S. Case No. 250/18, subject to the conditions as laid down under Section 438(2) of the Cr.P.C, it is further subject to the condition that:- (i) One of the bailors of the petitioner shall be a local person having sufficient immovable property within the jurisdiction of the concerned Court.
It is further made clear that the petition in no way shall threaten the informant otherwise the informant may move for cancellation of his bail bonds.
