The petitioner is languishing in custody since 13.6.2019 in a case registered for the offences punishable under Sections 302 and 201/34 of the I.P.C.

The prosecution case is that on recovery of a dead body with some injuries, the local Dafadar namely, Binod Singh lodged FIR against unknown. During investigation, the petitioner confessed his guilt and hence his name surfaced. It is submitted by learned counsel for the petitioner that the confession of the petitioner did not lead to any recovery and the petitioner denies to have made any confession before the police. Statement has been made in paragraph 3 of the petition that the petitioner is not having any criminal antecedent. Learned APP submits that the name of the petitioner

Considering the suspicious nature of accusation, the investigation being concluded, statement made in paragraph 3 of the petition that the petitioner is not having any criminal antecedent and the period in custody, let the petitioner above named be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned CJM, Gaya in connection with Bodh Gaya P.S. Case No.264 of 2019.
