2. The petitioner is apprehending his arrest in connection with Shahpur P.S. Case No. 433 of 2023 registered for the offences under section 379 of the Indian Penal Code and later on added Section 411 of the IPC lodged on 17.09.2023 by the informant, Dipu Kumar Gupta.

3. As per the prosecution story, the motorcycle of the informant was stolen on 16.09.2023 which he came to know on 17.09.2023 and accordingly, the FIR.

4. Subsequently, the motorcycle was recovered from the bushes at Kirani Chowk of the village and name of the petitioner came.

5. Learned counsel for the petitioner submits that his

6. Learned APP, Mr. Jitendra Kumar Singh opposes the prayer submitting that the FIR has been lodged in September 2023 and only after one of the accused was granted bail, the present petition has been filed belatedly and more than one year after the FIR was lodged.

7. Taking into account the aforesaid facts and the role of the petitioner, it would be appropriate that he seek bail.

8. The anticipatory bail application stands rejected.

9. If the petitioner surrenders within a period of four weeks, the Court concerned shall take up the matter and dispose it of preferable on the same day.
